With the new holiday law, you have the same right to vacation as you have now. However, the period where you earn paid vacation and the period where you can hold the vacation are changed.
Whereas you used to earn paid vacation in the calendar year of January 1st to December 31st, you will now with the new holiday law earn vacation as you go - from September 1st to August 31st the following year. You will, as it is today, earn 2.08 paid vacation days a month.
You will be able to use the payed vacation you have earned from September 1st to December 31st the following year i.e. a period of 16 months. This provides more flexibility when you take vacation.
With the old vacation law, if you were new to the Danish labour market, you could in some cases be forced to wait up to 1.5 years before you earned the right to paid vacation. With the new law, you can take vacation after one month. The vacation days you earn in this one month you can use to take vacation in the following month.
There will be a transition period before the new holiday law is effectuated.
You earn paid vacation according to the rules under the old law in the period of January 1st 2019 to and August 31st 2019. This earned vacation can be used to take paid vacation in the period of May 1st 2020 to September 30th 2020.
The vacation money you earn in the period from September 1st 2019 to and including August 31st 2020 will be frozen and not released until you leave the labour market. It is Lønmodtagernes Feriemidler who administrate the frozen vacation money, and in the first 3 months of 2021, you will receive a letter stating the final amount of vacation money. It is important that you check the information in that letter. The frozen money will earn interests until they are released to you.
From September 1st 2020, you will begin to earn paid vacation that you can take as you go.
New to the Danish Labour Market
If you have started working in Denmark after January 1st 2019, you will earn fewer vacation days to use in the period from May 1st to September 30th 2020. If you end up having earned less than 8.4 vacation days in 2019, you may have the option of taking the so called Fondsferiedage from May 1st 2020 to September 30th 2020.
